Terms of Service

About these terms

These terms govern your use of the RentCloud website and software service. By accessing the site or using the service you agree to these terms.

1. Parties and scope

These Terms govern the relationship between RentCloud ("RentCloud", "we") and the rental-business entity that signs up for a RentCloud account (the "Partner", "you"). They cover all access to and use of the RentCloud platform — dashboard, kiosks, API, contract-signing surfaces, and AI / "Cloud" features.

They do not govern the rental contract you generate with your end customer. That contract is between you (the Partner) and the end customer; RentCloud is a technical facilitator.

2. Account

You're responsible for the security of your account, for every action your staff takes inside it, and for keeping your contact email current. Sharing accounts between staff is not allowed — invite each user separately via Settings → Team.

3. Subscription and billing

  • Pricing is the plan you selected at sign-up or as adjusted in writing. Plans renew automatically each month or year (as applicable) unless cancelled before the renewal date.
  • We invoice you through Stripe. Invoices include the applicable VAT for your jurisdiction.
  • On top of the platform fee, an application fee of 2% applies to customer transactions you process via the embedded Stripe Connect integration. This fee is collected by Stripe and disclosed on each payment.
  • Failed renewals are retried with the Stripe dunning schedule. If three retries fail, your account is suspended pending payment.
  • Cancel any time from Settings → Subscription. You keep access until the end of the paid period; we don't refund the unused portion.

4. Acceptable use

You agree not to:

  • upload data you don't have the right to process,
  • use the platform to facilitate illegal rentals, fraud, or sanctions evasion,
  • reverse-engineer the platform or scrape it at scale,
  • circumvent rate limits, billing, or feature gates,
  • use the AI / "Cloud" features to generate content that violates applicable law (defamation, malware, illegal content).

5. Data processing

When you upload end-customer data (bookings, identification scans, signatures), you are the controller and RentCloud is your processor. The Data Processing Agreement annexed by reference to these Terms applies — Article 28 GDPR alignment, SCC-backed for any sub-processor outside the EEA. 6. Service availability

We target 99.5% monthly uptime measured at the API. Scheduled maintenance is announced at least 48 hours in advance and counted out of the uptime calculation. We do not commit to a specific response time for AI / "Cloud" features when the upstream model provider (Anthropic, Google) is unavailable.

7. Liability

RentCloud's total liability under these Terms is capped at the fees you paid in the 12 months preceding the event giving rise to the claim. We exclude liability for indirect, incidental, or consequential damages (lost profit, lost data not caused by our gross negligence, business interruption) to the extent permitted by Belgian law. Nothing in this section limits liability that can't lawfully be limited (gross negligence, intent, personal injury, breach of mandatory consumer-protection rules).

8. Suspension and termination

  • We may suspend your account if invoices are unpaid for 30 days, if we receive a credible report of misuse, or if there's a security incident on your tenant.
  • We may terminate for material breach with a 14-day cure period.
  • On termination we keep your data for 90 days to allow export, then anonymise / delete it per the Privacy Notice retention schedule.

9. Changes to these Terms

We can update these Terms with at least 30 days' email notice. The "Last updated" date at the top reflects the current effective version. If you don't agree with a material change, you can terminate before the effective date and we'll refund any prepaid unused portion.

10. Governing law and jurisdiction

These Terms are governed by RentCloud's place of establishment. The courts of the jurisdiction above have exclusive jurisdiction for any dispute, save the mandatory consumer-protection rules of your member state if those apply.
